SPORT STOCK ONLINE SHOP GENERAL TERMS AND CONDITIONS

1. PREAMBLE

The following are the general terms and conditions of Sport Stock GmbH Kaltenbach in Tyrol, Austria. These conditions apply to every purchase of goods via our website (Sportstock.at). Please read the following conditions carefully before placing your order.

The general terms and conditions apply to the ordering of goods from the goods offered in this online shop. By placing the order, the customer agrees to the following general terms and conditions.

 

2. CONTRACT CONCLUSION

“Consumer” means the person who acts as a consumer and buys goods for their own use.

“You” means the consumer who places the order for goods.

“Goods” means the goods that refer to these conditions and are offered on our website.

A letter that is sent by post, fax or email is recognized as “in writing”.

Orders are only accepted by customers who are 18 years or older. In the case of underage customers, the consent to submit an order from a legal representative is required. The customer's order represents a binding offer to conclude a purchase contract for the ordered goods.

An order is only possible if the customer data is given completely and truthfully. For each online order via the web shop, the customer receives an electronic order confirmation. The purchase contract is concluded when Sport Stock GmbH expressly accepts the order or it actually corresponds by sending the ordered goods. As soon as the contract has become effective, we will keep a copy of it in our files.

These conditions, starting with the confirmation of receipt up to the complete delivery, supersede any previously made conversations or information.

By accepting these conditions, you declare that you are a European citizen.

Third parties are not entitled to assert claims or rights from this contract.

 

3. ORDERS

Orders via website:

You can place orders on our website. However, you are responsible for paying any costs for connecting to our website.

If the goods you have ordered are not available, you will be informed.

Images, illustrations and descriptions of the goods are for your information only. For further information please contact our customer service.

Although we make every effort to ensure that our website is reliable and available around the clock, we must point out that the Internet is not a stable medium and that errors and interruptions could occur at any time. We give no guarantee for the reliability, completeness, execution, freedom from viruses or timeless content or service with regard to our website.

We are not liable for any damage arising from the contract (including no limitation to loss of profit or use), compensation (including negligence) or the like, except for these regulations are violations that are attributable to our negligence.

In the event that your connection to our website is interrupted, it could be that your shopping cart or already selected products are lost. In this case you would have to enter the goods again.

Before you send your order to us, you are once again given the opportunity to check your shopping cart, check the total purchase price and correct or remove any unintentional entries. Your order represents an official offer on your part to us to buy the goods you have specified. We will send you an order confirmation by email as soon as possible after the order has been placed. Please note that such an order confirmation is not the same as accepting your order.

The sale is only legally binding for us if we accept your order and we have sent the goods to you. This means that in the event that goods are displayed on our website but are not available or are accidentally advertised with an incorrect price or are otherwise incorrectly written, we are not obliged to sell such goods.

You only have to pay for the goods that have been sent to you.

 

4. PRICE

The price of the goods you have ordered will be displayed on our website before you have confirmed your order and will also appear on the written order confirmation you will receive after confirmation. All prices are in EURO (€) and include VAT.

If the delivery address is outside the EU, the prices are shown exclusive of VAT and the prices are also listed on the order confirmation exclusive of VAT. The customs duties and taxes incurred on delivery, including any import and export taxes, are to be borne by the buyer in the respective statutory amount.

If an error occurs in the billing for your ordered goods, we will inform you as soon as possible and offer you the option of either receiving the goods at the corrected price or canceling your order. If you cancel your order, we will of course refund the amount you have already paid to us.

 

5. PAYMENT

You have to pay for your goods in advance. For this we offer different payment methods: You can pay with credit card (Visa or Mastercard) as well as with PayPal or by bank transfer. Payment must, however, be made in EURO (€).

In the event that the amount due for payment cannot be debited - for whatever reason - the sale will be stopped and canceled immediately.

 

6. DELIVERY

The goods you have ordered will be delivered to the delivery address you have given us in your order after payment has been received during normal business hours.

Delivery will be made by express courier. Please note that deliveries are made to hand, to hotels or the like.

If the delivery address you have given us is not deliverable or if there is no one available who is authorized to accept deliveries, you will be asked to contact our customer service

Contact and announce an alternative delivery address or an alternative date for delivery.

No deliveries will be made as long as the payment of the goods is still outstanding. We ask you to note that each delivery date we give can only be taken as an estimate. We cannot be held responsible for any damage or loss due to late delivery, the cause of which can be attributed to you in a negligent or willful manner. Delivery should take place within 30 days.

Property and use, burden and risk pass to you after delivery.

If the goods are defective at the time of delivery, you are obliged to open the package in the presence of the courier. In the event of defective goods, you should write down the details of the delivery and contact our customer service.

 

7. LIMITATION OF LIABILITY

We cannot be held responsible for:

any losses that were not foreseeable by either party when the contract came into being, and

any losses that are not our fault.

Our liability in connection with this contract will not exceed the sales price.

We will repair or exchange our goods if the damage or loss is caused by our courier, provided that:

You send us a written statement of the damage or loss within 24 hours after the delivery date in the event of damage and within 24 hours after the delivery date you have been notified in the event of loss, so that we can compare the incident with the delivery service;

and you return all documents and documents you have received regarding the goods and (in the event of damage) the original packaging.

 

8. YOUR RIGHT TO CANCELLATION

If the customer is a consumer within the meaning of the KSchG and the contract has been concluded using only one or more means of distance communication, such as telephone, letter, fax, email, order form or web form from the online shop, he can withdraw from the contract or the declaration made withdraw from the contract without giving any reason up to the end of 7 working days (except Saturday), starting on the day the goods are received by the consumer. The customer has to bear the costs and expenses associated with the return of the goods.

In order to be able to exercise your right to cancel before delivery of the goods, you must send us a written confirmation by mail to Sportstock Kaltenbach in Tyrol, Austria, or by email to info@sportstock.at containing the goods you have ordered and Send the shipment (if necessary).

For your protection, we announce that you do not need to use an express delivery service for the return.

You will automatically receive a credit from us on our website for the amount you have paid for the goods after we have received the properly returned goods. If you would rather have the amount paid for the goods refunded to your account, you must send us a written statement by post to Sportstock GmbH or by email to info@sportstock.at within seven working days. We will transfer the amount after we have received the goods and at the latest within 30 working days to an account to be named by you. We would of course be happy to exchange the goods you have ordered for you.

We will not issue a refund for damaged or incomplete goods.

 

9. RIGHT OF WITHDRAWAL

 

You can make your contract declaration within 7 days without giving reasons either in writing (by letter, email or fax) or - if the order has already been delivered - by returning the item. The period begins after receipt of this instruction in writing, but not before receipt of the goods by the recipient (in the case of recurring delivery of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of our information obligations in accordance with Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 EGBGB as well as our obligations according to § 312g paragraph 1 Sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline.

Returns:

In the event of a valid revocation, the mutually received services must be returned and any benefits (e.g. interest) surrendered. If you are unable or partially unable to return or surrender the received service and benefits (e.g. advantages of use) or only in a deteriorated condition, you must compensate us for the value. You only have to pay compensation for the deterioration of the item if the deterioration is due to handling of the item that goes beyond the examination of the properties and functionality. “Checking the properties and functionality” means testing and trying out the respective goods, as is possible and customary in a shop.

You have to pay the costs of the return. We cannot make a new delivery to you as soon as we have not received the returned goods. You also have to bear the shipping costs for the reshipment.

Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the sending of your cancellation or the article, for us with its receipt.

 

10. EXCHANGE

If you buy products from us, they should:

In addition to your legal rights, we grant you the right to exchange the goods under the following conditions:

12.DELAY OR FAILURE

We are not liable for any delay or omission of any liabilities to you, provided that there are reasons that are not within our sphere, including explosions, flood, fire, accident, war or similar political conditions, strikes, forces of nature , industrial actions, any political interference, action or failure to act by a third party or our suppliers, action or failure to act on your part (e.g. if an incorrect delivery address is given or if there is no notification when the delivery address changes).

We will of course inform you immediately if such unpredictable cases occur. Should these conditions drag on for up to two weeks or longer, you are of course free to cancel your order and the refund will take place in accordance with point 8 of this contract.

 

13. FINAL PROVISIONS

The place of performance is exclusively Kaltenbach and applies exclusively to Austrian law excluding the UN sales law. If the legal transaction does not fall within the scope of the KSchG, the jurisdiction of the relevant court in Tyrol applies as agreed. Should individual points be ineffective, the remaining points of these general terms and conditions remain unaffected.
